In short: use Lanistably to run your coaching business, look after your clients' data properly, and we will look after it for you. Your data stays yours, you can take it out and leave whenever you like.
Who you are agreeing with
Lanistably is operated by Računalniško programiranje Zmago Devetak s.p., a sole trader registered in Slovenia (VAT SI18919880). "We" and "us" mean that business. "You" means the person or business holding a Lanistably account. Our registered address is on any invoice we issue and available on request from [email protected].
By creating an account you accept these terms and our Privacy Policy.
What Lanistably does
Lanistably is booking and client-management software for coaches and small studios. It lets you keep a client roster, schedule sessions, run recurring classes, share a booking page, take bookings and manage waitlists, record attendance, sell and track session packages, and keep notes and measurements.
It is a tool for running your business. It is not a substitute for professional judgement, and nothing in it is medical advice.
Your account
- You must be 18 or over and able to enter a contract.
- Give us accurate details and keep them current.
- Your sign-in is yours. Keep it to yourself, and tell us promptly if you think somebody else has it.
- Anything done through your account is your responsibility, including anything done by coaches you invite to your studio.
- You are responsible for what you and your team put into Lanistably.
What you may not do
- Break the law, or use Lanistably to help anyone else do so.
- Upload anything you have no right to, or anything unlawful.
- Record data about a person without a lawful basis for doing it.
- Try to reach another studio's data, or probe the service for weaknesses without asking us first. If you find a security problem, tell us — we would much rather hear it from you.
- Resell Lanistably, or run it as a service for others, without our agreement.
- Put load on the service that degrades it for other people.
Your clients' data
This is the important part. Your clients' records are yours, not ours. You decide what happens to them; we hold them for you and do as you instruct.
In data protection terms you are the controller of your clients' personal data and we are your processor. This section is the agreement required by Article 28 of the GDPR, and it forms part of these terms.
What we undertake
- We process your clients' data only to provide Lanistably to you, and only on your documented instructions — using the product is the instruction.
- We never use it for our own purposes: no advertising, no profiling, no model training, no selling it to anybody.
- Everyone with access is bound to keep it confidential.
- We take appropriate technical and organisational measures to keep it safe, described in our Privacy Policy.
- We use the sub-processors listed in that policy — hosting, email and payments — each under a written contract on terms no weaker than these. We will tell you before adding one, and you may object.
- We help you answer your clients when they ask for their data, want it corrected, or want it deleted.
- We tell you without undue delay if we become aware of a breach affecting your data.
- We give you a way to export your data, and we delete it when you close your account.
- We make available what you reasonably need to show you are complying, including answering your questions about how we work.
What you undertake
- You have a lawful basis for every person whose details you record, and you have told them how their data is used.
- Where you record health-related information — body measurements, injuries, conditions — you have the explicit consent that Article 9 requires, or another lawful basis under it.
- Where a client is a minor, you have a parent's or guardian's consent.
- You keep your clients' data accurate, and remove what you no longer need.
- Your instructions to us will not put us in breach of the law.
Scope
We process the categories of data described in our Privacy Policy, about the clients and staff you add, for as long as your account is open, in order to provide the service. On closure we delete it, subject to the backup and invoice retention periods in that policy.
Money
What Lanistably costs
Lanistably is currently free to use. If we introduce charges we will tell you well before they apply to you, and you will be free to export your data and leave rather than pay.
Money you take from your clients
Lanistably does not process payments for you. The prices and payments you record are your own bookkeeping. Money moves between you and your client by whatever means you arrange, and we are not a party to it.
That means refunds, disputes, unpaid packages and tax on what you earn are between you and your client. We are not involved and cannot intervene.
Your data is yours
You keep every right in the content you put into Lanistably. We claim no ownership of it. We hold it only to run the service for you, and we use it for nothing else.
You can export your data at any time. If you would like it in a form the product does not currently offer, ask us and we will get it to you.
Availability
We work to keep Lanistably running and we take backups, but we do not promise it will never be unavailable. It may go down for maintenance, or because something we depend on has failed.
Keep your own copy of anything you could not stand to lose. Reminders and confirmations depend on email providers we do not control, so a message may be delayed or land in a spam folder — do not rely on Lanistably as the only way your clients hear from you about something that matters.
Ending it
You can close your account whenever you like, from your account settings or by asking us. Closing it deletes your data as described in the Privacy Policy, so export anything you want to keep first.
We may suspend or close an account that breaks these terms, or that puts other people's data or the service itself at risk. Except where the law requires otherwise, or where waiting would cause harm, we will tell you why and give you a chance to put it right.
Liability
Lanistably is provided as it is. To the extent the law allows, we exclude implied warranties, and we are not liable for lost profit, lost business, or data you lost that you could have kept a copy of.
Where we are liable, our total liability is limited to what you have paid us in the twelve months before the claim, or €100 if that is more.
Nothing here excludes liability that cannot be excluded by law — including death or personal injury caused by our negligence, fraud, and, if you are a consumer, your statutory rights.
Changes
We may change these terms. When we change something that matters, we will update the date at the top of this page and ask you to accept the new version the next time you sign in. If you would rather not accept it, you can export your data and close your account.
Law
These terms are governed by Slovenian law, and the courts of Slovenia have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings there.
